Compo bid after woman's botched boob job
A LEGAL team representing the victim of a botched boob job today vowed to pursue a compo claim.
Andrea Scott suffered a criss-cross of scars after stitches on her breast burst open following an op at the Tyneside surgery of Dr Ashish Dutta.
A panel at the Medical Practitioners Tribunal Service suspended the respected doc after deciding he had blundered post-op care.
Now a legal team acting for Andrea said they would be lodging papers with the courts in a bid to win compensation.
It comes as a bid to overturn the ruling has seen a panel demand more information before returning a verdict.
Angela Kirtley, a specialist from Irwin Mitchell, said: “We will be serving the papers on Dr Dutta in January.”
Experienced surgeon Dr Dutta – who says he has carried out more than 140 successful breast augmentation procedures – was suspended for the way he handled Andrea’s post-op care.
Andrea, 32, who lives in Consett, Country Durham, with her partner Aaron, 46, and co-runs the Talk Plan Solutions Ltd mobile phone company, shelled out more than £4,500 to even out the size of her breasts in January 2010.
But after having the op, which was carried out by another surgeon, the stitches on her left breast burst open and her implants began sagging from the wound. Andrea said she suffered an 18-month post-op nightmare after enduring four separate procedures by Dr Dutta to correct the procedure.
Now a team from Dr Dutta’s surgery have posted an online statement which says he will continue to carry out some procedures which do “not require medical registration”.
These include wrinkle treatment, microdermabrasion and some laser treatments.
The statement states: “Following a September 2012 ruling by the MPTS, Dr Ashish Dutta has been suspended from practicing for a period of 12 months.
“We have appointed other surgeons to carry out procedures in the interim and will review the situation at the appropriate time.
“There are certain procedures, eg. dermal fillers, lasers and IPL, microdermabrasion, which do not require medical registration.
“Dr Dutta will continue to provide these treatments. We are sorry for the inconvenience caused, but will ensure that all our patients are looked after with our usual high standard of care.”
Following a hearing before the Medical Practitioners Tribunal, chairman Reverend Robert Lloyd-Richards branded Dr Dutta’s actions a risk to patients and said his “behaviour included elements of abuse of position/trust and of putting your own interests above those of your patient”.
