Breach of confidentiality Empty Breach of confidentiality

Post by EmmaArden 17th March 2012, 2:43 pm

This might not be the best forum to post it on, but I'm thinking about my legal rights about a workplace situation and I was wondering if anybody was to know of them?
Just so you are aware of my situation, I told 3 people at work about getting my boobs done in case something went wrong and so that I can get help with lifting heavy objects etc. My line manager was informed of this situation by me, and then without him askin me for my permission he told another manager (I can't remember the exact wording but something like) " I have a duty to inform management" now, I could have done this without them knowing at work, so I dont understand why this was mentioned. I don't have a problem with people knowing, it's just I am expecting a perverted dig at one point and I preparing my defence basically. So I was just wondering of there was a breach of confidentiality and could I get him done? Or am I just being OTT?
Thanks again xxx

I don't think legally there's a problem with him telling another manager, but the perverted dig could be classed as bullying/sexual harrassment.

I think he shouldn't have told the other person if you didn't want him to out of respect for you. But I don't think Managers have a confidentiality thing... only doctors and healthcare professionals

I dont think there is a breach as he did tell you he "has" to tell management. They will say it's for your well being and he did inform you. With managment the best thing to do is ask what the process is if you were to take time off for a cosmetic procedure, who would they tell and what will they do with this information. Then you decide if you will formally tell them of the procedure or tell them it's an op (and not tell them what sort of op). If you get any type of comment that is derogetory, you need to make sure you have a witness and then you can do the sexual harassment/bullying etc. With any metting with a manager you are allowed to take a colleague in with you, as a representative. I would ensure that you make sure you do this with any future contact with this manager if you are worried he will make a comment.
